Royalty-free licence

When you purchase a photo from www.skylark.co.nz, you agree to, and are bound by, the following royalty-free licence, referred to as “Licence”.

The Licence is exclusive to you and non-transferable. You must not pass on, transfer or sell the Licence. The Licence grants you perpetual use of the photo. The ownership and copyright of the photo remains with the photographer, Markus Baumann of Skylark Productions.

Permitted use of the photo

• On printed materials: promotional, editorial and packaging, in formats such as newspapers, magazines, reports, books, brochures, calendars, prints, disc covers and catalogues.
• On electronic media: promotional and editorial in electronic and digital formats such as screensavers, websites, television, video and multimedia products.

Prohibited use of the photo

• Display the photo in an electronic format with a resolution greater than 800×600 pixels.
• Display the photo in a way that it is intended to be downloaded.
• Sell, rent, lease, loan, give, transfer the right to use the photo.
• Use the photo for pornography, defamatory, libellous, obscene, immoral, fraudulent or otherwise unlawful uses.
• Use the photo or accompanying material in a way other than described in the above permitted uses.

Licence changes

I may, at my discretion, update or revise the Licence from time to time. Any changes will take effect immediately once they are posted on my website. Changes made to the Licence after the purchase of a photo do not apply retrospectively.
